The Romanian Minority in Croatia

On microphone: Emil Rațiu (Asociația culturale lu istro-rumeni 'Andrei Glavina' On 18th February 1994 a Treaty of friendship and cooperation was signed at Bucharest, between the governments of Romania and the Republic of Croatia, providing for the assistance, by the respective States, of the minority groups living in both countries.

To date, this treaty, which was ratified by the Romanian parliament in September 1994, has remained unenforced, with regard to the Romanians of Croatia, who are not legally recognized as a minority ethnic and linguistic group in Croatia and have no cultural institutions, Church or schools in their own language.

The Istro-Romanians language school ceased to exist in 1925 following the death of the great teacher Andrei Glavina, and the two young Romanians sent by their community to study as teachers in Romania, in 1935, never returned to their country, prevented from doing so first by the war and then by the Communist regime established in Yugoslavia.

The administrative autonomy of the Istro-Romanians - embodied in the Istro-Romanian municipality of Valdarsa - was abolished in 1943, following the coming to power of Tito and the Communists, who refused the community any rights. The process of rapid disappearance of the ethnic minority due to assimilation by the Croatian population is ongoing and occurring at an even faster rate than in the past, since compulsory school attendance and the invasiveness of the Croatian-language mass media has made the survival of an ethnic minority with no schools or mass media in its own language a virtually impossible feat.

Thus, we are appealing to the Federal Union of European Nationalities (FUEN) - whose task it is to protect small minorities unprotected by any laws - to request the application of the international and national laws on the protection of minorities and small ethnic groups, also in favor of the Istro-Romanians.

In this respect, we wish to expressly quote the documents by the Organization for Economic Cooperation and Development, the European Charter of Regional and Minority Languages of 5th November 1992, the Framework Convention for Minorities in Europe of 1995 and the bilingual agreements and treaties, such as the above mentioned Romanian-Croatian Treaty of Friendship and Cooperation of 18th February 1994 and the Agreement on Cooperation in the fields of education, culture and science between the Government of Romania and the Government of the Republic Croatia, signed on 19th May 1993 (articles 2 &d, 4 and 15).

All the above mentioned treaties and agreements provide for school teaching in the language of the minority and have been punctually applied in Romania in favor of the Croatian minority (about 3.000 persons), while they remain unenforced for the Romanian minorities in Istria (about 1.000 persons who declared themselves Romanian communities in the Mura and Drava Valleys, who are legally gathered into a national association since 1995, with headquarters at Pribislavec. Therefore, we appeal to the FUEN so that, in accordance with art. 3 of its charter, it mazy contact the Croatian and Romanian governments to request the application of the laws and bilateral agreements in favor of the minorities, amongst which the Romanian minority in Croatia, and so that it may raise the issue before the international organizations such as the Council of Europe, the Council of Europe’s ad hoc Committee for the Protection of National Minorities, the Council of Europe’s Committee for Culture and Education, the Office of the OSCE High Commissioner for national Minorities at the Hague, the European Parliament’s Committee for Juridical Affairs and the Rights of Citizens and all the other organizations dealing with the protection of minorities.


La Minorité Roumaine en Croatie

Au microphone: Emil Rațiu (Asociația culturale lu istro-rumeni 'Andrei Glavina' La 18 février 1994 un traité d'amitié et de collaboration fut signé à Bucarest entre la Roumanie et la République de Croatie, prévoyant l'assistance des groupes minoritaires de l'un et l'autre pays.

Ce traité déjà ratifié par le parlement roumain depuis septembre 1994, n'a pas encore reçu d'application concrète pour les Roumains de Croatie qui ne jouissent pas de la reconnaissance légale comme groupe ethnique-linguistique minoritaire sur le territoire de la Croatie et n'ont pas aucune institution culturelle - Eglise, école - dans la langue maternelle. L'école des Istro-Roumains dans leur propre langue a cessé d'exister depuis 1925, avec la mort de leur grand maître Andrei Glavina et les deux jeunes hommes envoyés par leur communauté en 1935 pour étudier en Roumanie comme instituteurs, n'ont pas pu rentrer chez eux, à cause de la guerre et du régime communiste instauré en Jougoslavie.

L'autonomie administrative des Istro-Roumains - la commune istro-roumaine de Valdarsa - cessa en 1943 avec l'instauration de l'administration communiste de Tito, qui n'a leur reconnu aucun droit.

Dès lors, le processus de rapide disparition ethnique par assimilation à la population croate continue, tant il est évident qu’à l'époque de la scolarisation obligatoire de masse, et dans mass-médias qui arrivent jusqu' aux foyers les plus isolés, la survie d'un petit groupe ethnique est impossible sans école et mass-médias dans sa propre langue.

Is est de notre devoir d'en appeler à l'UFCE - qui doit défendre les petites minorités non garanties et non soutenues par aucune loi - pour demander l'application des lois internationales et nationales en matière de minorité et de petits groupes ethniques, même aux Istro-Roumains. Nous citons expressément les Documents de la Conférence pour la Sécurité et la Coopération en Europe et les normes généralement reconnues par le droit international, y compris la Charte européenne des langues régionales ou minoritaires, signée à Strasbourg le 5 novembre 1992, la Convention-quadre pour les minorités en Europe de 1995, ainsi que les accords et traités bilatéraux comme le Traité de collaboration et d'amitié roumano-croate conclu à Bucarest le 18 février 1994 et "Agreement on cooperation in the fields of education, culture and science between the Government of Romania and the Government of the Republic of Croatia," signé le 19 mai 1993 à Zagreb l'article 2, article 4 et article 15.

Tous ces accords et traités prévoient l'enseignement scolastique dans la langue maternelle et sont appliqués depuis longtemps en Roumanie à faveur de la petite minorité croate (environ 3000 personnes), mai ils ne sont pas appliqués pour les Roumains d'Istrie (environ 1000 personnes qui se sont déclarées tels au recensement croate de 1991, mai qui en réalité sont plus nombreuses) et ils ne sont même pas appliqués pour les Roumains des vallées de Mura et de Drava, plus nombreux, qui se sont constitués légalement dans une association nationale en 1995, ayant le siège à Pribislavec.

Nous en appelons donc à l'UFCE pour que sur la base de l'article 3 de sont statut, elle veule prendre contact avec les autorités responsable croate et roumaines en vue de faire appliquer toutes ces lois et tous ces accords bilatéraux et internationaux même aux Roumains de Croatie et d'intéresser à leur sort les organisations internationales: les Conseil de l'Europe et son Comité ad-hoc pou la protection des minorités nationales, la Commission de la culture et de l'éducation de Conseil de l'Europe, l'Haut Commissaire pour les affaires juridiques et les droits des citoyens au Parlement européen à Bruxelles et toutes les organisations intéressées à la condition des minorités nationales.


Die Rumänen in Kroatien

Am Mikrophon: Emil Rațiu,  Asociația culturale lu istro-rumeni 'Andrei Glavina' Am 18 Februar 1994 wurde in Bukarest ein Freundschafts- und Zusammenarbeitsvertrag zwischen Rumänien und der kroatischen Republik unterzeichnet, der die Unterstützung der Minderheiten beider Länder durch die Vertragspartner vorsah.

Dieser bereits seit September 1994 durch das rumänische Parlament ratifizierte Vertrag hat bisher keine Anwendung für die Rumänen Kroatiens gefunden, die als ethnisch-linguistische Minderheitengruppe im Hoheitsgebiet Kroatiens weder rechtliche Anerkennung genießen noch eine kulturelle Einrichtung - Kirche, Schule - in ihrer Sprache besitzen.

Die Schule der Istrien-Rumänen hat ihren Betrieb bereits 1925, mit dem Tod ihres großen Vorbildes Andrej Glawina, eingestellt, und die beiden jungen Rumänen, die 1935 von ihrer Volksgruppe nach Rumänien gesandt worden waren, um dort ihr Studium als Lehrer zu absolvieren, sind nicht mehr in ihre Heimat zurückgekehrt; der Krieg und das inzwischen in Jugoslawien herrschende kommunistische Regime haben sie daran gehindert.

Der Selbstverwaltung der Istrien-Rumänen – der istrianisch-rumänischen Gemeinde von Valdarsa – machte 1943 die Errichtung der kommunitischen Verwaltung von Tito ein Ende, die ihr keinerlei Rechte zugestanden hat. Die Geschwindigkeit des Prozesses des beschleunigten ethnischen Verschwindens über die Assimilierung durch die kroatische Bevölkerung nimmt auch heute weiter zu, denn in einer Zeit der Massenschulpflicht und der Massenmedien in der Sprache der Mehrheitsbevölkerung ist ein Überleben für eine kleine Volksgruppe ohne Schule und ohne Massenkommunikationsmittel in ihrer Muttersprache nicht möglich.

Aus diesem Grund wenden wir uns an die Föderalistische Union Europäischer Volksgruppen - die die Aufgabe hat sich unter anderem für die kleinen - durch mangelnde Gesetze geschützten Minderheiten einzusetzen - und beantragen auch zugunsten der Istrien-Rumänen die Anwendung der internationalen und nationalen Schutzgesetze für die Minderheiten und kleinen Volksgruppen. Wir zitieren ausdrücklich die Dokumente der Organisation für die Kooperation und die Sicherheit in Europa, das Europäische Statut für die Regional – oder Minderheitensprachen vom 05 November 1992, das Rahmenabkommen für die Minderheiten in Europa von 1995 und die bilateralen Vereinbarungen und Verträge, wie den rumänisch-kroatischen Zusammenarbeits- und Freundschaftsvertrag vom 18.02.1994 und das am 19.05.1993 unterzeichnete "Agreement on cooperation in the fields of education, culture and science between the Government of Romania and the Government of the Republic of Croatia," Art.2 d, Art. 4 und Art. 15.

All diese Vereinbarungen und Verträge sehen den Unterricht der eigenen Sprache in den Schulen vor und werden seit langer Zeit in Rumänien zugunsten der kleinen kroatischen Minderheit (ca. 3000 Personen) nicht aber zugunsten der Istrien-Rumänen angewandt (1000 Personen ungefähr, die sich als solche anläßlich der Volkszählung von 1991 erklärt haben, bei denen es sich aber in Wirklichkeit um eine größere Anzahl handelt) und auch nicht zugunsten der Rumänen des Mura- und des Drava-Tals, die zahlreicher sind, und die sich 1995 rechtlich zu einem nationalen verband mit Sitz in Pribislavec zusammengeschlossen haben.

Wir wenden uns deshalb an die Föderalistische Union Europäischer Volksgruppen, damit dies gemäß Art. 3 ihrer Satzung Kontakt mit der kroatischen und der rumänischen Regierung zwecks Anwendung der bilateralen Gesetze und Vereinbarungen bezugnehmend auf die Minderheiten auch zugunsten der Rumänen von Kroatien aufnimmt und auch die internationalen Organisationen auffordert, sich für den Schutz dieser letzteren einzusetzen: den Europarat, den eigens dafür geschaffenen Ausschuß des Europarates für den Schutz der nationalen Minderheiten, den Kultur- und Erziehungsausschuß des Europarates, das mit dem Schutz der Minderheiten beauftragte Hochkommissariat der Organisation für Sicherheit und Zusammenarbeit in Europa (OSZE) in Den Haag, den Ausschuß für Rechtsangelegenheiten und Bürgerrechte beim Europäischen Parlament und alle anderen Organe, die am Geschick der nationalen Minderheiten interessiert sind.
